The customer acknowledges having read and accepted the general regulations printed overleaf. The rental company makes the equipment available to the customer, who accepts and acknowledges having received it in good condition, in accordance with its intended purpose, equipped with paddles and buoyancy aids, in the appropriate number and size. The customer undertakes to return the borrowed boat(s) in good condition within the time limit specified above for the rental period. The customer undertakes to return the boat(s) to the place where it/they were borrowed during opening hours, at the end of the rental period, indicated above. In the event of loss or theft, the customer undertakes to make a declaration to the competent authorities within 48 hours. The customer declares that he/she is covered by civil liability insurance. The customer must provide a deposit cheque, which will not be cashed, to be returned when the equipment is returned in good condition, or proof of identity. Signing this contract implies full acceptance of the general rental regulations.
General regulations for Expénature boat rentals
Article 1: Purpose of the contract
Boat rental" is provided by Expénature. The rental conditions are an integral part of the rental contract. By signing, the renter confirms having read and fully accepted the rental conditions.
Article 2: General terms and conditions
- To take possession of the boat, the renter must show proof of identity.
- Unaccompanied minors under 18 years of age are not permitted. Equipment rental is agreed for the duration and number of people per boat specified in the contract.
- When the equipment is made available by the rental company, the hirer is asked to pay a deposit or give his identity card for the duration of the rental. This is returned to the hirer on return of the equipment, less any damage caused. If the equipment is not returned within the agreed time, an invoice for the equivalent of the purchase price will be sent to the borrower.
- Rental takes effect when the hirer takes possession of the equipment.
- The hirer acknowledges having received the equipment in good condition and undertakes to use the boat with care and to pay for any damage caused, in accordance with current rates.
- The renter is responsible for any damage, theft or loss of the rented equipment. The customer must return the boat and equipment in good condition to Expénature at the end of the rental period defined in the contract.
- If, following an accident or illness, the hirer is unable to return the rented equipment, he/she will do so through a third party.
- By express agreement between the parties, the lending or subletting of equipment is strictly forbidden.
- The hirer undertakes not to abandon his or her boat, life jackets or paddles.
- The tenant guarantees to be covered by third-party liability insurance.
- The rental company is not responsible for parked vehicles or items entrusted to it.
- The lessor does not guarantee the watertightness of the containers loaned, as this is subject to closure by the users.
Article 3: Special conditions
- The lessor is not responsible for the conditions under which the lessee uses the equipment.
- The rental company informs the customer of any special conditions relating to the use of the equipment, which the customer acknowledges having been informed of and undertakes to respect.
- The customer must not have any medical contraindications to the activity, such as seasickness or excessive transport.
- It is the customer's responsibility to find out about the weather ahead of time, and to adapt his or her itinerary to the 300m band.
If the customer feels unable to ensure the safety of his or her group, he or she is strongly advised to opt for a supervised outing with a guide. The rental company accepts no responsibility for the physical, technical or emotional abilities of participants. - It is forbidden to use the equipment with children under 6, even if accompanied by an adult.
- Customers must be able to swim at least 25 meters.
- The customer must have informed himself/herself of the possible difficulties and dangers of the route(s).
- Customers must wear closed-toe shoes and have their lifejacket closed.
- The supply of cartographic documents concerning possible nautical routes is purely indicative.
- When at sea, customers must give way to all other boats.
- The customer must not stray more than 300m from a coastline.
- For all outings accompanied by a guide, the customer is informed that the activity will be confirmed if the minimum number of 5 participants is established on the slot.
Article 4: Insurance - liability
In accordance with articles 1383 and 1384 of the French Civil Code, the lessee is liable for any damage caused to third parties. For all rented boats, the lessee is always held responsible for bodily injury and/or material damage that he/she may cause to third parties while using the rented boats, which he/she acknowledges to have legal custody of, from the moment he/she takes possession of them until they are returned. Expénature is not liable for any damage suffered or caused by the borrower in connection with the use of the boats made available. However, the lessee shall not be held liable for the harmful consequences of hidden defects in the rented equipment, or for wear and tear that is not apparent and unfit for the use for which it was intended, insofar as proof of said defects or wear and tear can be provided by the lessee. The lessee must be insured and undertakes to contact his insurance company for any damage caused to third parties as a result of his use of the rented boat. By signing the rental contract, the lessee confirms that he/she has adequately covered the risks involved in the excursion. Except in cases of force majeure, all accidents must be reported as soon as possible, and within 24 hours at the latest.
Customers wishing to hire equipment through a company for a seminar, team building or group outing during working hours must hire a service with a guide. It is also possible to hire equipment, but only if the company's insurance covers the liability associated with our activities. In the case of dry hire (without supervision), you take the following risks: No guarantee if the accident is not due to a defect in the equipment. No individual accident cover for participants. Liability of the organization (employer, volunteer supervisor, group leader). Article 5: Rates and methods of payment for services
The entire service is paid for by the hirer when the equipment covered by this contract is made available. The following methods of payment are accepted: cheques, cash, ANCV, EANCV, gift vouchers, and credit card payment via the website.
